Terms of service

These terms describe the agreement between you and BetterWayIQ Smart Scheduling ("BetterWayIQ," "we," or "us") when you use our scheduling product. By creating an account or using the service, you agree to these terms. If you don't agree, don't use the service.
Plain-English summary: We provide a workforce-scheduling tool. You bring your business data — your employees, your sales history, your shifts. You own that data. We charge for the service unless you're a pilot customer (free during MVP). Either of us can end the relationship at any time. We don't guarantee the service is perfect, and we cap our liability at what you've paid us. The specifics below.
The service
BetterWayIQ is a web application that helps small-business owners build, publish, and revise schedules for their hourly staff. The current scope is described on our home page, pricing page, and FAQ. We add features over time; removing or changing existing features is uncommon, but we reserve the right to do so on reasonable notice.
BetterWayIQ is an employer-facing tool. It is not a time clock and not an employee app. You are responsible for tracking hours actually worked and for paying employees correctly under your local labor laws.
Your account
- You must be authorized to act on behalf of the business you're configuring in BetterWayIQ. Adding employees, locations, and pay rates implies that authority.
- Keep your login credentials confidential. Notify us promptly if you suspect an account has been accessed by someone who shouldn't have it.
- You're responsible for the accuracy of the data you put in — employee names, hourly rates, sales numbers, availability rules. We compute on the data you give us; we don't verify it independently.
Your data
- You own it. Employee records, schedules, sales imports, and audit trails are yours.
- We're a processor. We process your data only to provide the service to you. The handling specifics are in our privacy policy.
- Export anytime. The product offers CSV exports for the data you put in. Email us if you need a bulk export beyond what the UI provides.
Acceptable use
Don't use BetterWayIQ to:
- Violate any law (your employees' labor rights, privacy laws, etc.).
- Upload data you don't have the right to upload.
- Reverse engineer, scrape, or attempt to compromise the service or another tenant's data.
- Resell access to the service or use it as a backend for a competing scheduling product.
Tenants are isolated at the database level via row-level security; trying to cross that boundary is grounds for immediate termination.
Billing
- During pilot: free. We're in MVP build-out and pilot customers get the full Pro tier free in exchange for honest feedback.
- After pilot: the rates on our pricing page apply. Billing is monthly or annual at your choice; annual saves 20%.
- Changes: upgrade or downgrade tiers at any time. Annual is prorated; monthly takes effect at the next cycle.
- Late payment:if a payment fails, we'll email you and retry. After 14 days of unpaid balance we may suspend access until the balance is settled. Your data stays put during suspension and is restored on payment.
- Refunds: on annual plans, we refund the unused portion if you cancel mid-term and we caused you a real problem. Otherwise refunds are at our discretion.
Cancellation and termination
- You can cancel at any time from the account settings or by emailing us. Your tenant's data is deleted within 30 days of cancellation, except where we're legally required to retain it.
- We may terminate an account that violates these terms (after notice, except in cases of security or legal urgency).
- Either of us may walk away with reasonable notice if the relationship isn't working. We'll give at least 30 days' notice on a unilateral termination unless your account has been compromised or used to break the law.
Service availability
We aim for high uptime but we don't promise it. The service is provided on an "as-is" and "as-available" basis. We don't warrant that the service will be uninterrupted, error-free, or that every forecast or schedule recommendation will be correct for your business.
We monitor the service and respond to outages promptly. Sub-processor availability (Supabase, Vercel, Resend) is outside our direct control; their status pages are linked in our privacy policy.
Limitation of liability
To the maximum extent allowed by law:
- We're not liable for indirect, consequential, or incidental damages — lost profits, lost data caused by your own actions, missed opportunities, and similar.
- Our total liability for any claim is capped at the amount you've paid us in the 12 months preceding the claim. For pilot customers, this cap is $100.
- We're not liable for labor-law decisions made on the basis of our forecasts or schedules. The forecast is a tool; the staffing call is yours.
Some jurisdictions don't allow these limits. Where that's the case, our liability is the minimum allowed by law.
Changes to these terms
When we update these terms materially, we'll update the "Last updated" date above and, if you have an account, send you an email at the address on file before the change takes effect. Continued use after the effective date means you accept the new terms.
Governing law
These terms are governed by the laws of the state where BetterWayIQ is organized as a business. Disputes that we can't resolve directly will be handled in the courts of that state. We'll always try to resolve a dispute over email first — call it before lawyering up.
